1. Seller and scope of these terms
These terms govern purchases of goods through the SIM Garage online shop operated by C.V.G. s. r. o.. They form part of the purchase contract between the seller and buyer.
Consumer provisions apply only when the buyer enters into the contract outside their business activity. A different agreement in a specific contract takes precedence, but it may not restrict consumer rights that cannot be excluded by contract.

2. Goods, prices and availability
The main characteristics, price and availability of goods are shown for each product. Prices are stated in Czech koruna and include VAT unless the page expressly states otherwise. Delivery costs and any costs of the selected payment method are shown before the order is submitted.
Availability information reflects the shop's current stock. If goods cannot be supplied after ordering, the seller will contact the buyer without undue delay and refund any payment received using the original method unless agreed otherwise.
4. Payment and delivery
Checkout displays the available payment and delivery methods according to the shop's current settings. Online payments are provided by Comgate a.s., a licensed payment institution supervised by the Czech National Bank. Data transferred to the payment gateway is secured and encrypted. The seller does not receive or store full payment card details. Further information and contact details are available on the Comgate website.
Goods will be delivered using the method selected in the order. The specific delivery price, pickup point and availability estimate are shown before submission. Unless agreed otherwise, the seller will deliver without undue delay and no later than 30 days after the contract is concluded.
The risk of damage passes to the consumer upon receipt. The packaging should be checked on receipt and visible parcel damage recorded with the carrier. This does not limit statutory rights arising from defective performance.
5. Consumer withdrawal from the contract
A consumer may withdraw from a distance contract without giving a reason within 14 days of receiving the goods. For several items delivered separately, the period begins when the final item or part of the delivery is received.
The notice must be sent no later than the final day of the period. The model form on the Claims and returns page may be used, or an unambiguous statement can be sent to info@simgarage.cz. The goods must be sent back within 14 days of withdrawal.
- The consumer bears the direct return costs unless the seller states otherwise.
- The seller refunds the money received, including the cost of the least expensive standard delivery method offered.
- The refund may be withheld until the goods are received or proof of dispatch is provided.
- The consumer is liable only for diminished value caused by handling beyond what is necessary to establish the nature and characteristics of the goods.
Withdrawal is not possible in cases specified by law, especially for goods made to the consumer's specifications or clearly personalised, and sealed goods that cannot be returned for hygiene reasons after the seal has been broken.
6. Rights arising from defects and claims
The seller is responsible to the consumer for goods being free from defects on receipt and having the agreed and usual characteristics. A consumer may raise a defect that appears within two years of receipt. If it appears during the first year, the goods are presumed to have been defective on receipt unless proven otherwise.
A claim can be made by email, at the seller's registered office or by another agreed method. Detailed instructions and contact details are on the Claims and returns page. A consumer claim will be handled and the consumer informed within 30 days unless a longer period is agreed.
7. Alternative dispute resolution
If a dispute cannot be resolved directly with the seller, the consumer may submit a proposal for alternative dispute resolution to the Czech Trade Inspection Authority.

8. Final provisions
Legal relations are governed by Czech law. This does not deprive a consumer of the protection provided by mandatory provisions of the law of their habitual residence. The invalidity of one provision does not affect the validity of the others.
Changes to these terms apply only to orders submitted after their effective date unless the parties agree otherwise.
